Justification
Strengthening LAB's operational structure and framework in within the LAB's mandate for delivering of accessible, timely and quality legal aid services. Enhancing the operational structure and framework through a functional review and the review of the Legal Aid Act 2011 and related laws is highly significant because it strengthens both the internal efficiency and the legal foundation of the Legal Aid Bureau (LAB). A functional review helps to assess and realign roles, processes, and workflows within the institution. This eliminates duplication, clarifies responsibilities, fills emerging gaps, and improves coordination, leading to faster decision-making and more efficient service delivery. The functional review will support creation of more posts for more officers to match increasing work demands and creates more senior positions for career progression, job satisfaction whilst simultaneously arresting high staff turnover. Additionally, it ensures that the organizational structure is fit for purpose and responsive to current demands. At the same time, reviewing the Legal Aid Act and related laws will address both legal and regulatory limitations that may be restricting service delivery. It creates an enabling environment for reforms such as expanding the roles of paralegals, improving access to justice, and modernizing how legal aid services are provided. The law reform will also increase the types of cases for which legal aid may be granted. For instance, currently LAB cannot represent people in defamation claims, yet some people are prejudiced because of defamatory statements. For instance, old people are ordinarily accused of witchcraft, and some have been killed. Other indigent people have lost opportunities because of damaged reputations, which they have been unable to redeem with the assistance of LAB. Currently people who have these claims but cannot afford private lawyers are left without recourse to legal representation under the law. Law reform will also increase the categories of officers who can provide legal representation in courts, besides lawyers. This will ensure that an enhanced number of clients is assisted. Together, the two elements enhance accountability, consistency, and quality of services, while also promoting adaptability and long-term sustainability.
