Justification
The duties assigned to the MIE under Section 84 of the Education Act 2013 are vast and fundamental to the entire education system. An Institution with such a critical, system-wide role requires a legal framework that provides deep, detailed guidance tailored specifically to these complex functions. A dedicated MIE Act would allow for a more comprehensive elaboration of its core mission, standards, and strategic objectives, elevating its status from just another body under the general Education Act to the nation's premier curriculum and pedagogical research institution
The Education Act 2013 grants the MIE a considerable degree of autonomy, which is indicative of an institution that needs to operate independently. This level of autonomy is more characteristic of a major parastatal than a simple department within a ministry. A separate MIE Act would be the appropriate legal instrument to fully define the boundaries of this autonomy, its relationship with the Ministry of Education, and its accountability mechanisms, preventing potential conflicts or ambiguities that could arise from being governed under a broader, more general act.
Currently, the MIE's entire legal basis is contained within Part XI of the Education Act 2013. Any change to its structure, functions, or funding requires an amendment to the overarching Education Act.Therefore a standalone MIE Act would bring all provisions related to the Institute into one clear, focused document, making it easier for stakeholders, staff, and partners to understand its legal standing and operations.
